2. OBJECT

These General Terms of Use (hereinafter, “GTU”) regulate the access, browsing, and utilization of the Website accessible through the domain https://www.apad-apad.org/, as well as the liabilities derived from the use of its contents. “Contents” shall be understood to include texts, graphics, drawings, designs, codes, software, photographs, music, videos, sounds, databases, images, expressions, and information, as well as any other creation protected by national laws and international treaties on intellectual and industrial property.

The primary purpose of the Website is to offer corporate information about A.P.A.D., as well as to enable direct contact with the organization through forms.

  • Using the Website for purposes that are unlawful, illegal, or contrary to the provisions of these GTU, good faith, and public order.

5. EXCLUSION OF WARRANTIES AND LIABILITY

5.2. Exclusion of Warranties and Liability for the Contents

A.P.A.D. does not guarantee the reliability, utility, truthfulness, accuracy, completeness, and timeliness of the Contents. The User acknowledges that the use of the Website and its Contents is carried out under their sole and exclusive responsibility.

5.3. Exclusion of Liability for Services Provided by Third Parties through the Website

The Website may make available to the User technical linking devices (such as links, banners, buttons), directories, and search tools that allow access to websites belonging to and/or managed by third parties. A.P.A.D. does not assume any liability for the information contained therein nor for any damages that may arise from accessing them.

5.4. Exclusion of Liability for the Conduct of Users

A.P.A.D. shall not be liable for damages of any nature derived from the use that Users make of the Website in contravention of these GTU or the law.

6. HYPERLINKS

Those persons intending to establish hyperlinks between their webpage and this Website must observe the following conditions: prior authorization shall not be necessary when the hyperlink only allows access to the homepage of the Website, but it may not reproduce it in any form. Any other form of hyperlink shall require the express, unequivocal, and written authorization of A.P.A.D. The webpage on which the hyperlink is established shall not contain unlawful information or content contrary to morality, good customs, or public order. A.P.A.D. reserves the right to block hyperlinks that do not have express authorization.

7. ACTIONS IN EVENT OF BREACH

A.P.A.D. reserves the right to exercise any actions available under the law to demand the liabilities arising from the breach of any of the provisions of these GTU by the User.

8. SEVERABILITY

The declaration of any of the clauses contained in these GTU as null, void, or ineffective shall not affect the validity or effectiveness of the remaining clauses, which shall continue to be binding between the parties.

9. PRIVACY AND COOKIES POLICY

The processing of personal data is regulated in the Privacy Policy, and the installation of cookies is regulated in the Cookies Policy, both of which are available on the Website.

10. NOTIFICATIONS

For the purpose of serving appropriate notices, A.P.A.D. designates the contact address specified in the Legal Notice. The email address provided by the User during the registration process will be used by A.P.A.D. for notification purposes. The User is obliged to keep their contact details properly updated.

11. APPLICABLE LAW AND JURISDICTION

These GTU shall be governed by the provisions of Spanish legislation. Any controversy relating to these GTU shall be submitted to the corresponding Courts, with the parties expressly waiving any other jurisdiction that may correspond to them, unless otherwise determined by legal mandate.
